Wrongful Death, Permanent Disability, Life-Threatening Permanent Injury, Medical
Malpractice, Defective Product, Failure to adequately warn of risks.
Potential Cause of Action
Manufacturer, physicians and marketing materials may have failed to properly inform
diabetes patients of the risk of permanent injury and death associated with Benicar®
use. The FDA has issued a Warning Letter to the manufacturer for “false or misleading”
product promotion.
Aggravating Circumstance: FDA approved Benicar® in 2002. Two clinical trials
(ROADMAP and ORIENT), indicating the drug may increase the risk of death in patients
with diabetes, is not completed until 2009. During this time, Benicar® is heavily promoted and prescribed for patients with hypertension. In 2010, the FDA announces
“Ongoing Safety Review” of the 2009 clinical trials where patients had “a higher rate of
death from a cardiovascular cause compared to patients taking a placebo.”
Client Origination and Aggregation Challenges
Most of the potential plaintiffs injured by prescription use of Benicar® may not be aware
that Benicar® has caused their injury or the death of their loved one. Although
mainstream media coverage is expected in this case, the issue has yet to be broadly
published in the media and the prescribing physicians are unlikely to inform the injured
patients or patient’s family that the prescription they wrote caused the injury or death.
